Thompson Cigar Top Off Program Terms and Conditions (Last Updated on August 15, 2022)

Welcome to Thompson Cigar Top Off Program, operated by Lilly Online, LLC d/b/a Thompson Cigar (“Thompson Cigar”, “we”, “us” or “our”). By registering to become a member (a “Member” or “you” or your”) of the Thompson Cigar Top Off Program (“Top Off” or the “Program) and by participating in the Program, you (i) represent that you are 21 years of age and (ii) agree to be bound by these Program Terms and Conditions (“Terms”). By enrolling you are electing to receive Program emails. You may review these Terms at any time by clicking the link on the Top Off homepage. PLEASE NOTE, THE TOP OFF PROGRAM IS SCHEDULED TO TERMINATE ON AUGUST 31, 2022 AND IS CLOSED TO NEW MEMBERS. SEE TERMS FOR DETAILS.  

Top Off Overview

Top Off is a pre-pay program by which Members may purchase a dollar amount (“Deposit”) that gets credited to their account and, in return, Members receive bonus dollars (“Rewards”) based on the Deposit amount purchased. 

If a Member is also enrolled in the Subscribe and Save program (Subscribe and Save Program Terms & Conditions), they will receive additional bonus dollars (“Rewards”) based on the amount purchased. 

Members have the option to select one-time, monthly, or quarterly Deposits. Members can modify their Deposit selection at any time. Program is available for online orders only; payment by check is prohibited.

For any Deposit made between Monday and Thursday, Deposits and Rewards will be available 17 hours after Deposit. For any Deposit after 4 pm EST on Friday, Deposits and Rewards will be available 72 hours after Deposit.

Rewards will not be available until the following day after Deposit.

Rewards may be use used towards the purchase of hand rolled cigars, accessories, and clubs (excluding Convenient Shipment Club).

Rewards may not be used towards the purchase of machine rolled cigars or gift cards. Further, Rewards may not be used for payment of federal, state, or local taxes, or for payment of shipping and handling costs. 

Rewards are not redeemable for cash and have no cash value. Rewards are non-transferable and non-refundable and cannot be applied to prior purchases. Rewards from one Member account cannot be combined with Rewards from another Member account. 

Rewards can be used in conjunction with other discounts or offers for the purchase of eligible products, not to exceed the purchase amount. No change/currency will be given for Reward redemptions. The total transaction amount after Top Off Rewards are redeemed must be $.01 or greater.

Entire Deposit amount entered at checkout will be withdrawn from account at the time of the order, regardless of items' inventory status. In the event we are unable to ship the backordered product, we will contact you and you will have the option to cancel the backorder or replace with an alternative item. We will refund the amount of deposit allocated to canceled items back to the account. If the order has a refund or return and there were multiple forms of payment involved (i.e. Top Off and Credit Card or Top Off and PayPal) the refund/return would be applied back to your Top Off account first, and remaining funds to the credit card or PayPal. Top Off Deposit amounts are not available with purchasing a gift card alone, or in combination with merchandise.

Deposits are non-transferable and cannot be combined with Deposits from another Member account. Deposits may be refunded at the sole discretion of Thompson Cigar and then only in unusual circumstances.

Customers with Terms (formerly “Bill Me”) are not eligible to participate in the Program. Any customer that would like to become a Member must forfeit Terms. Accounts with outstanding balances are not eligible to participate in the Program.

Members will receive Rewards based on Deposits as follows:

Your unused Deposit as of August 31, 2022 will be refunded to you by October 31, 2022 as follows: (a) any Deposit made by credit card will be refunded to your credit card; (b) any Deposit made by PayPal will be refunded by a physical check mailed to your residence. 

Rewards expire the earlier of six (6) months after issuance OR on August 31, 2022. 

Eligibility: You must be age 21 years or older to be eligible for membership in the Top Off Program. Limit of one Program Membership per account. 

How to Join: Top of Club is closed to new Members as of August 31, 2022. If you provided any Registration Data that is untrue, inaccurate, not current, or incomplete, or if Thompson Cigar, in its discretion, suspects that your Registration Data is untrue, inaccurate, not current, or incomplete, Thompson Cigar has the right to suspend or terminate your current or future use of the Program. 

Once enrollment has been completed, you are a Member and can start to purchase Deposit amounts and earn associated Rewards. 

Thompson Cigar reserves the right to offer bonus and other promotional opportunities to select Members based on purchase activity, geographical location, program participation, and/or other factors. Thompson Cigar also reserves the right to change such offers at any time.

Please refer to our Privacy Policy to review how we collect, use, and share information from and about you, and the choices you have regarding your information. 

General Terms of the Top Off Program 

Membership and its benefits are offered at the sole discretion of Thompson Cigar. 

Thompson Cigar may, in its discretion, cancel, modify, restrict, or terminate the Program or any aspects, features or Terms of the Program at any time without prior notice. Updated Terms will be available at Thompson Cigar (see “Last Updated” above). Such changes shall become effective immediately upon posting and shall apply to unredeemed Deposits and Rewards, as well as Deposits and Rewards earned in the future. Members are responsible for remaining knowledgeable about the Program’s current Terms. 

These Terms shall be governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Member agrees to accept personal and exclusive jurisdiction of the state or federal courts for the county of Northampton, Pennsylvania regarding any dispute arising from or related to the Program. 

The interpretation and application of the Program’s Terms are at Thompson Cigar’s sole discretion. 

The Program is subject to all applicable laws and regulations and is void where prohibited. 

The sale, barter, or offer of any Program Rewards, other than by Thompson Cigar, is expressly prohibited.

By enrolling in the Program, each Member represents that he or she is of sufficient legal age to use the Program and to create binding legal obligations for any liability Member may incur as a result of the Program.

You agree not to intentionally or unintentionally violate any applicable laws and regulations, or any Terms, rules or requirements established by Thompson Cigar in connection with your use of the Program.

Thompson Cigar will not be liable for any of the following: incorrect Registration Data or Member information; problems related to any of the equipment or programming associated with or utilized by the Member; any human error; any interruption, deletion, omission, defect, or line failure of any telephone network or electronic transmission; problems relating to computer equipment, software, or inability to access the website; any other technical or non-technical error or malfunction; lost, late, stolen, illegible, incomplete, garbled, misdirected, mutilated, or postage due mail, or other mail for whatever reason.

This Program is only open to individual participants, and not to corporations, businesses, or commercial enterprises. 

The failure of Thompson Cigar to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

To resolve any account discrepancies, Members must contact Thompson Cigar in writing within 60 days following the transaction in question by using this Customer Service form. Members must provide Thompson Cigar with sufficient written documentation of the transaction(s) in question. In the case of a dispute regarding the Program, Thompson Cigar’s decision will be final.
